Explanation of the Bill

House Bill 1081 would establish a law declaring the following:

  • The United States Supreme Court has recognized that parents have a fundamental right to direct the upbringing of their children. 
  • The due process clause includes the fundamental right of parents to direct the education, upbringing, care and control of their children.

The bill further declares that no agency or officer of the state, or of any subdivision in the state, could infringe on these rights. 
Exceptions would only be made in the case of laws “tailored to meet a compelling governmental interest.” In these cases, officials would be required to use “the least restrictive means” to meet their objectives.
