Explanation of the Bill
House Bill 1133 would revise the Cardiac Emergency Response Plan law.
Revisions to the Law
Current law requires public schools to develop Cardiac Emergency Response Plans (CERPs) to use in cases of emergency on school grounds. HB 1133 would additionally require plans to cover emergencies on school athletic venue grounds.
Current law requires Automated External Defibrillators (AEDs) to be placed in accordance with guidance set by the American Heart Association or another evidence-based standard. HB 1133 would additionally require AEDs to be identified with appropriate signage and to be available in an unlocked location on school property within three minutes of each school athletic venue. The devices would be required to be accessible during the school day and during athletic events or practices.
Funding for CERPs
HB 1133 would designate $2,499,000 to aid in implementing CERPs. Funding could be used for the purchase and maintenance of AEDs, the purchase of training materials on CPR and first aid, and other activities and equipment related to CERPs. High-needs schools would be given funding priority. The bill defines high-needs schools as schools where at least 50% of children are eligible to receive free and reduced-priced meals, schools participating in the Community Eligibility Provision or Universal Free Meals, or Title 1 schools.
HB 1133 would direct the Mississippi Department of Education (MDE) to establish a procedure for monitoring schools’ compliance with funding requirements.
School boards, charter school operators, and governing bodies of private schools would be permitted to accept gifts, grants, and donations for the purchase of AEDs and for the costs of maintaining the devices.
This act would take effect on July 1, 2025.
