On April 1, the House and Senate adopted the conference report for SB 2267. The conference report simply removes the reverse repealer from the bill.

Explanation of the Bill

Senate Bill 2267 would establish the Mississippi Statewide Data Exchange Act. 

The bill would task the Mississippi Department of Information Technology Services (ITS) with conducting a comprehensive study to assess the feasibility, operational requirements, and policy considerations for the implementation of a statewide data exchange initiative. Such an initiative would support data sharing among state agencies and other authorized entities to “support enhanced digital government services.”

Based on the findings of the study, ITS would develop and oversee the implementation of a cloud-based data exchange platform that enables agencies to share their data with each other. The platform would be designed to:

  • Facilitate data sharing among state agencies and other authorized entities, while ensuring data privacy; 
  • Enable an interoperability framework, allowing agencies to validate existing state-provided programs to improve service delivery and reduce redundancy; and
  • Implement data governance in alignment with state and federal laws and regulations.

Chief Information Officer Council

To ensure ongoing oversight and guidance, ITS would establish a Chief Information Officer (CIO) Counctil, composed of information and technology leadership from state agencies. The CIO Council would be responsible for:

  • Providing recommendations on technical standards, interoperability frameworks and cybersecurity protocols;
  • Facilitating interagency collaboration to maximize data-sharing efficiency; 
  • Ensuring that the statewide data exchange aligns with agency-specific and statewide goals developed to “enhance digital government services”; and
  • Serve as an advisory body to ITS in evaluating the long-term sustainability of the platform. 

Rules and Regulations

The bill would give the ITS the authority to create necessary rules and regulations to design, develop, implement, monitor, and update the statewide data exchange platform. ITS would also be responsible for creating the governance policies of the platform and leading interagency coordination efforts.

Timeline

The ITS would be required to adhere to the following timeline: 

  • By October 1, 2025, ITS would establish the CIO Council and its governance framework;
  • Within six months of the CIO Council’s first meeting, the council would conduct a feasibility study regarding the requirements of the Mississippi Statewide Data Exchange Act. IT would report its findings and recommendations to the Legislature. 
  • Within six months of sending this report to the Legislature, the CIO Council would develop a phased implementation plan for the Mississippi Statewide Data Exchange; 
  • Within one year of approving the phased implementation plan, the ITS and CIO Council would launch the initial pilot program of the data exchange; 
  • Within one year of launching the pilot program, the ITS and CIO Council would implement a full statewide rollout of the program;
  • After full implementation of the program, the CIO would submit annual reports to the legislature regarding the status of the program, system enhancements made to the program, and any additional information necessary to develop “enhanced digital government experiences” via the data exchange. 

As amended by the House, the bill contains a reverse repealer, indicating there will be changes made to the bill in conference.
